Yes, of course. It's still called innocent before proven guilty, and it's not a constant among cultures, so it's always better to check. Figure out whether people believe that the burden of proof lies with the accuser or the defendant.

On a personal level I agree that if there isn't the evidence then they shouldn't be convicted.
